As per the case facts the appeal was filed under Section of the National Green Tribunal Act challenging an order by the National Green Tribunal NGT that dismissed an application ... for the closure of a Common Bio-Medical Waste Treatment Facility The appellant sought closure due to alleged non-compliance with the Environmental Impact Assessment Notification The question arose whether the Bio-Medical Waste Treatment facility operating with consent to operate could be closed solely for the want of a prior Environmental Clearance and whether such closure would be against public interest Finally the Supreme Court dismissed the appeal holding that the NGT rightly found that the facility operating with requisite consent could not be closed simply for want of prior environmental clearance as closing such a facility would be against public interest
