The present appellants have filed this appeal by special leave against the judgment and order dated August rendered by the Uttarakhand High Court in Nainital in Civil Revision The judgment ... allowed the revision petition filed by the respondents in this case and as a result the appellants' application under Section of the Cpc for permission to institute a suit was denied In the current case this Court will have to decide whether the High Court was justified in overturning the permission to file suit order based on its interpretation of the case's facts and circumstances and the decisions made by the lower court while using its jurisdiction under Section of the CPC
